By confirming your booking the following is an agreement between 'The Kombi Booth' and 'The Client" for the hiring of a Kombi Photo Booth and related services from The Kombi Booth.
Definitions:
The Kombi Booth: The Kombi Booth and any employees of The Kombi Booth.
The Client: The person, organisation, company or other bodies which are hiring the goods and services as specified on the client portal.
Event date: The time and date of the event, confirmed by The Kombi Booth and noted on the client portal.
Client Portal: Access to the online portal, upon confirming booking which is signed by, or on behalf of, The Client specifying details of the booking.
Booking Confirmation:
1.1. A booking is not confirmed until The Client completes online booking form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from The Kombi Booth.
Payments:
3.1. A non-refundable deposit of $200 of the booking cost is payable upon booking. The booking is not confirmed until the deposit has been received by The Kombi Booth.
3.2. The balance of the booking cost is payable 14 days prior to the booked event date.
3.3. If the balance of the booking cost and the bond (if required) are not received more than 14 days prior to the event date, the booking will be cancelled and the client will forfeit the deposit.
3.4. If a booking is made within 14 days of the event date, full payment is due within 48 hours. If the booking is made within 7 days of the event date, full payment is due within 24 hours.
3.5. If the client requests use of The Kombi Booth services in excess of the time noted on the Booking Agreement, this will be billed at $300 for each additional hour or part-hour.
Access, Space, Power and Internet Requirements:
4.1. The Kombi Booth will arrive 1 hour (60 minutes) prior to your booked event start time to setup. If The Client requires The Kombi Photo Booth to be setup earlier than this, then an early setup idle fee will apply at $100 per hour.
4.2 The client shall ensure a safe and appropriate environment is provided for The Kombi Booth to operate its equipment.
4.3. The client must ensure:
– a space of 3 m x 5 m or more has been organised for the photo booth setup.
– all access paths are at least 2m wide x 2.1m high.
– a flat surface is made available for the set-up.
– Wi-Fi connection for any hires that require this service.
4.4. The client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include, but are not limited to, parking, permits and electricity.
4.5. If The Clients’ event takes place inside a venue, adequate access and notice must be provided to the setup location. If The Kombi Booth are not informed by The Client prior to arriving at the venue, then The Client accepts that the photo booth may not be able to be set up at their event, and they will forfeit any payments made.
Social Media:
5.1. Social media uploading and sharing requires a strong signal for internet connection. The Kombi Booth is not responsible if your venue does not have signal, and we strongly advise The Client check this prior to their event.
5.2. Social media uploading is subject to the availability of the service itself. We have no control over any social platforms, and therefore will not be liable for any downtime or non-availability of this service.
5.3. The Client accepts responsibility for all photos shared on social media by guests at the event. The Kombi Booth reserves the right to remove photos from social media.
5.4. The Client gives permission for all photos uploaded to social media to be shared by The Kombi Booth on our own social media platforms and websites.
Changes and Cancellations:
6.1. Requests for changes to the event date must be made in writing at least 30 days prior to the original event date. A date change is subject to availability and receipt of confirmation from The Kombi Booth.
6.2. All cancellations will result in the client forfeiting the deposit, however, if The Kombi Booth is notified of cancellation more than 30 days prior to the event date, credit to the value of the deposit will be given to the client to use for any future booking made within 6 months of the date of cancellation.
6.3. Cancellations made within 30 days of the event date will result in the client forfeiting all payments made to The Kombi Booth, with the exception of the bond (if paid) which will be returned to the client within 5 business days after the date of cancellation.
6.4. If The Client wishes to end their service earlier on the day than the agreed time, they will not receive a refund or deduction from their full payment.
6.5. The Kombi Booth can cancel any booking at any time. If The Kombi Booth decides to cancel a booking, all payments made will be refunded to the Client and every attempt will be made to find a replacement service to maintain the booking.
Damage to Equipment:
7.1. In order to prevent damage to equipment, The Kombi Booth reserves the right to deny service to any person.
7.2. If circumstances arise where a threat or implied threat of harm, damage or violence to The Kombi Booth staff or equipment, The Kombi Booth reserves the right to cease providing services. Any damage to The Kombi Booth equipment during the client’s event caused by the client, client’s guests or any other person in attendance at the event, whether invited or not, will result in the cost to repair/replace the equipment to be deducted from the client’s bond (if paid). The client is liable for extra costs If the cost to repair/replace is more than the bond or if a bond was not paid.
Use of Images:
8.1. The Client gives permission for all photos taken during the event to be used on the The Kombi Booth website and other promotional material.
Indemnification:
9.1. The Kombi Booth will not be held responsible for any circumstances beyond their control. This includes, but is not limited to, fire, riot, civil commotion, accidents, acts of nature and equipment failure.
9.2. The client agrees that in all circumstances, The Kombi Booth's liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.
